The Law of Ukraine “On Copyright and Related Rights” applies. The new version of the Law came into effect on January 1, 2023 (Law No. 2811-IX of December 1, 2022).
1. General Provisions
These Terms of Service regulate the relationship between the Administration of the Modista website (hereinafter — “Editorial Board”) and the User (hereinafter — “You”) regarding the use of content posted on the website (https://modistaua.com/). Your use of any materials on the site automatically constitutes your agreement to these Terms.
2. Copyright and Content Ownership
All textual, graphic, photo, and video content, as well as design elements and software code published on the Modista website, are subjects of copyright and belong to the Editorial Board (or are used on legal grounds).
Our rights are protected by the legislation of Ukraine and international intellectual property treaties, specifically:
- The Law of Ukraine “On Copyright and Related Rights” (current version).

- The Civil Code of Ukraine (Chapter 36 “Intellectual Property Law”).
3. Rules for Using Site Materials (Copying)
3.1. Permitted Use (Citation)
Without the written consent of the Editorial Board, the following is allowed:
- Citation: The use of small fragments (quotes) of text materials that have the character of ordinary press information, with the mandatory mention of the author’s name (if available) and an active hyperlink to the original source (Modista) in the first paragraph or immediately after the quote.
- Brief use of news: The use of a headline and a small (up to 300 characters) introductory paragraph of news material is allowed, but with a mandatory active hyperlink to the original article.
3.2. Strictly Prohibited Use (Content Theft)
It is strictly prohibited without a written license agreement with the Editorial Board:
- Full or partial copying, reproduction, reprinting (rewrite), or other use of site materials (articles, reviews, analytics) that exceeds the norms of permitted citation.
- The use of photos, graphic images, and video content created by the Editorial Board without a direct license.
4. Liability for Copyright Infringement
Any violation of the rules for using content set forth in Section 3 is a copyright infringement and entails liability provided for by the Law of Ukraine “On Copyright and Related Rights”, in particular:
- According to Article 52 (Protection of copyright and related rights) and Article 53 (Methods of protection) of the Law, the Editorial Board has the right to appeal to the court for damages.
- For the illegal use of objects of copyright, according to Article 52, the Editorial Board has the right to demand compensation in an amount determined by the court, from 10 to 50,000 minimum wages.
In case of detection of unauthorized use of content, the Editorial Board reserves the right to:
- Send a demand (DMCA complaint) to the hosting provider and domain registrar of the infringer to remove illegally placed content.
- Demand compensation for losses in pre-trial or judicial proceedings.
5. Change of Terms
The Editorial Board reserves the right to unilaterally make changes to these Terms of Service. Changes take effect from the moment of their publication on this page.
